What is the difference between Mediation, Arbitration and Hybrid sessions?
Following are the definitions of Mediation and Arbitration approved by the Florida Supreme Court.
Rule 10.210. Mediation Defined
Mediation is a process whereby a neutral and impartial third person acts to encourage and facilitate the resolution of a dispute without prescribing what it should be. It is an informal and non-adversarial process intended to help disputing parties reach a mutually acceptable agreement.
Rule 11.030. (b) Arbitration Defined
Pursuant to chapter 44, Florida Statutes, arbitration is a process whereby a neutral third person or panel considers the facts and arguments presented by the parties and renders a decision which may be binding or nonbinding.
Hybrid Session
A Hybrid Session is the name given to scheduling a mediation session which, if not settled, immediately transitions into an Arbitration session.
